NOC for court marriage An American citizen (or any non-Indian) getting married in India
Marriage is the beautiful union of hearts. If you are looking for marriage in India, there are some requirements and eligibility criteria you need to follow. We tried to cover all the requirements, but if something is still missing, you may contact us for detailed information and consultation.
For an American citizen (or any non-Indian) to get married in India through a court marriage, several documents and procedures need to be followed. A No Objection Certificate (NOC) is often required as part of this process.
Steps to Obtain a No Objection Certificate (NOC)
Visit the Embassy/Consulate: The foreign national (in this case, the American citizen) needs to visit the nearest U.S. Embassy or Consulate in India.
Affidavit of Eligibility to Marry: The foreign national must complete an Affidavit of Eligibility to Marry. This document states that they are legally free to marry and is usually notarized by a consular officer at the embassy or consulate.
Supporting Documents: The following documents are typically required:
Passport: Valid passport with a visa.
Proof of Residence: Proof of address in India (if applicable).
Divorce Decree/Death Certificate: If previously married, the foreign national must provide a divorce decree or a death certificate of the previous spouse.
Birth Certificate: For age verification.
Application and Fee: Submit the application for the NOC along with the required fee. The consular office will process the application and issue the NOC if everything is in order.
Court Marriage Procedure in India
Notice of Intended Marriage: File a notice of intended marriage with the Marriage Registrar of the district where at least one of the parties has resided for at least 30 days immediately preceding the date of the notice. This notice is under the Special Marriage Act, 1954.
Publication of Notice: The notice is published by the registrar, and a 30-day waiting period follows during which objections can be raised.
Objections: If no objections are received within 30 days, the marriage can proceed. If objections are raised, the Registrar will investigate and decide whether the marriage can take place.
Documents Required for Court Marriage:
Proof of Age: Birth certificate, passport, or other valid documents.
Proof of Residence: Address proof such as an Aadhaar card, utility bill, etc.
Affidavit: Affidavit stating the marital status (unmarried, divorced, widowed) of both parties.
Passport-Sized Photographs: Typically 4-6 photographs.
NOC from Embassy/Consulate: As discussed, for the foreign national.
Proof of Divorce/Death: If either party was previously married,
Marriage Ceremony: After the 30-day period, the marriage ceremony is conducted in the presence of the Marriage Registrar and three witnesses.
Marriage Certificate: The Marriage Registrar issues a marriage certificate, which is a legal proof of marriage.
Additional
Legal Assistance: It might be helpful to engage a local lawyer who is familiar with the process to ensure all legal requirements are met.
Translation of Documents: If any document is in a language other than English or Hindi, it might need to be translated and notarized.
Check for Updates: Always check with the respective embassy/consulate and local marriage registration office for any updates or changes in requirements.
